Welcome to MaineBound Designs. These Terms of Service (“Terms”) govern your use of our website located at gomainebounddesigns.com (the “Site”) and your purchase of products through our Site or our Etsy shop at etsy.com/shop/MaineBoundDesigns (collectively, the “Platforms”). By accessing or using our Platforms, you agree to be bound by these Terms in their entirety.

If you do not agree with these Terms, please do not use our Platforms or make any purchases.

1. Acceptance of Terms

By using this Site, placing an order, or otherwise interacting with MaineBound Designs, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have the legal capacity to enter into a binding agreement, and that you agree to comply with all applicable laws and these Terms.

2. Intellectual Property

2.1 Ownership of Designs

All original graphic designs, artwork, illustrations, photographs, logos, slogans, and branding materials available on our Platforms — including all Maine-inspired artwork featured on our products — are the exclusive intellectual property of MaineBound Designs or our licensed designers. These works are protected by United States copyright law, trademark law, and international intellectual property treaties.

2.2 Limited License

When you purchase a product from MaineBound Designs, you receive a limited, non-exclusive, non-transferable license to use that physical product for personal, non-commercial purposes. This license does not include:

• The right to reproduce, copy, or redistribute any design element digitally or in print.
• The right to create derivative works based on our designs.
• The right to use our designs for commercial purposes, resale, or sublicensing.

2.3 Prohibited Use

You may not, under any circumstances:

• Copy, download, screen-capture, or otherwise reproduce our product images or design files without written permission.
• Use our designs on competing products or resell our designs.
• Use our name, logo, or trademark in a way that suggests an affiliation or endorsement without our express written consent.

We actively monitor for intellectual property infringement and will pursue legal remedies, including DMCA takedowns and civil litigation, against violators.

3. Accuracy of Billing & Account Information

When placing an order, you agree to provide current, complete, and accurate purchase and account information. This includes:

• Your correct legal name as it appears on your payment method.
• A valid email address you actively check.
• Your correct shipping address, including unit numbers, zip codes, and country.
• Valid payment information.

MaineBound Designs reserves the right to cancel or limit any orders placed with inaccurate, fraudulent, or incomplete information. We are not responsible for delivery failures or delays resulting from incorrect information provided at checkout.

4. Pricing, Product Descriptions & Modification

4.1 Pricing

All prices displayed on our Platforms are in United States Dollars (USD) unless otherwise indicated. Prices are subject to change without notice. Sales tax may be applied depending on your location and applicable laws. Shipping fees are calculated at checkout based on your location and order weight.

4.2 Product Descriptions

We strive to accurately describe and display our products. However, we do not warrant that product descriptions, colors, images, or other content are completely accurate, complete, or error-free. Digital mockups may not perfectly represent the finished physical product, and minor color variations are normal and expected in print-on-demand production.

4.3 Right to Modify or Discontinue

MaineBound Designs reserves the right at any time to:

• Modify, update, or discontinue any product or design.
• Change prices with reasonable notice.
• Limit quantities available for purchase.
• Refuse service to any customer or cancel any order at our sole discretion.

5. Custom Orders & User-Submitted Content

5.1 Custom Order Process

Customers may request custom designs for eligible products. By submitting a custom order request, you represent and warrant that:

• You own or have the legal right to use any images, text, logos, or other content you submit for customization.
• Your submitted content does not infringe upon any third-party copyright, trademark, privacy right, or other intellectual property right.
• Your submitted content does not include unlawful, offensive, defamatory, pornographic, or otherwise inappropriate material.

5.2 License Grant for Submitted Content

By submitting content for a custom order, you grant MaineBound Designs a limited, non-exclusive license to use that content solely for the purpose of producing your custom product. We will not use your submitted content for any other purpose, nor will we share it with third parties except as necessary to fulfill your order.

5.3 Our Right to Decline

MaineBound Designs reserves the right to decline any custom order request that we determine, in our sole discretion, violates these Terms, our values, or applicable law.

6. Returns, Cancellations & Replacements

Because all products are custom printed to order, MaineBound Designs does not accept returns or exchanges for reasons of buyer’s remorse or personal preference. Orders may be cancelled within 1 hour of placement, prior to production beginning. Damaged, misprinted, or incorrect items are eligible for free replacement within 7 days of delivery with photo documentation. For full details, see our Customer Service & Logistics page.

7. Limitation of Liability

To the maximum extent permitted by applicable law, MaineBound Designs, its owners, employees, agents, and production partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of our Platforms or products.
• Loss of profits, data, goodwill, or other intangible losses.
• Any errors or omissions in product descriptions, pricing, or images.
• Delays or failures in delivery caused by shipping carriers, customs authorities, or events beyond our control (including natural disasters, pandemics, or carrier disruptions).
• Any unauthorized access to or alteration of your personal data by third parties, provided we have implemented reasonable security measures.

In any event, our total liability to you for any claim arising out of or relating to these Terms or your use of our Platforms shall not exceed the total amount you paid for the specific order giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless MaineBound Designs and its owners, agents, and employees from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your use of our Platforms, or your infringement of any third-party intellectual property or other rights.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Maine, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of our Platforms shall be resolved exclusively in the state or federal courts located in the State of Maine, and you consent to the personal jurisdiction of those courts.

Before initiating formal legal action, we encourage you to contact us directly to resolve any dispute informally. We will make good-faith efforts to address your concerns within 30 days.

10. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. Continued use of our Platforms after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
